Terms of Service

1. Our service

We prepare and register BASIX certificates in New South Wales for:

• swimming pools and spas with a water capacity of 40,000 litres or more; and
• alterations and additions with an estimated construction cost of $50,000 or more.

We do not currently offer certificates for new dwellings, and we do not provide NatHERS thermal assessments. Same Day Basix is an independent service and is not affiliated with the NSW Government or NSW Planning. BASIX is a NSW Government program, and certificates are generated and registered through the NSW Government’s BASIX tool.

2. Prices and payment

• Prices are shown on our website and at checkout. They exclude GST, which is added at checkout. The current prices are $119 plus GST ($130.90 total) for a pool or spa certificate and $159 plus GST ($174.90 total) for alterations and additions.
• Prices include the NSW Government BASIX registration fee (currently $33), which we pay on your behalf when the certificate is registered.
• Payment is made in full by card when you order, through our secure checkout. Card payments are processed by Stripe.
• We issue a tax invoice from AustechHub Pty Ltd with GST shown separately.

3. Timing

Orders received before 3pm (Sydney time), Monday to Friday, are assessed within two business hours and we aim to email your registered certificate the same business day. Orders received after 3pm, on weekends or on NSW public holidays are handled from the start of the next business day. These timeframes depend on you giving us complete and accurate information and on the NSW Government’s systems being available. If we need more information from you, or if the project does not meet the BASIX targets and changes need to be agreed, delivery may take longer.

If you paid for your order before 3pm (Sydney time) on a business day, Monday to Friday, gave us complete information, and we do not deliver your certificate that same business day for reasons within our control, you can choose either a refund or 50% off the service price.

4. Your responsibilities

• Give us complete and accurate information about your project. The certificate is prepared from the information you provide, and errors can make it invalid or require a new certificate.
• Check the certificate and tell us promptly if anything is wrong.
• Build to the commitments in the certificate. BASIX commitments are checked at final inspection, and meeting them is the responsibility of the owner and builder.
• Submit the certificate with your development application or complying development certificate application within three months of its date of issue.

5. Meeting the BASIX targets

If your project does not meet a BASIX target, we will explain the changes that would allow it to pass, such as a pool cover, a different heating option or improved glazing or insulation. Decisions about design changes are yours, and some changes may add cost to your build.

6. Revisions

Each order includes one free revision within 60 days of the certificate being issued, if your design changes. A revision covers the same project and the same property only. Any extra cost, including any additional NSW Government fee, is passed on to you.

7. Cancellations and refunds

Cancellations and refunds are covered by our Refund Policy. Nothing in these terms limits your rights under the Australian Consumer Law.

8. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill, will be fit for any purpose you make known to us, and will be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have under the law.

9. Limitation of liability

To the extent permitted by law, and except for the consumer guarantees, we are not liable for any indirect or consequential loss, including delays to your project caused by council, certifier or NSW Government processes. Where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failure to comply with a consumer guarantee is limited, where the law allows, to supplying the services again or paying the cost of having them supplied again.

10. Privacy

We handle your personal information in line with our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. The version on this page when you place your order applies to that order.

12. Governing law

These terms are governed by the laws of New South Wales, Australia.
